Anheuser-Busch Inc. is a dominating global leader in the beer industry, specifically in the United States. Its roots can be traced all the way back to 1852 from the Bavarian Brewery in St. Louis MO when Adolphus Busch traveled from Germany to join his father-in-law. In 1876 Budweiser was founded and rooted its brand in values, ethics, and quality. These core staples of the company evolved all the way to 1982 when Bud Light was introduced. Today Bud Light is the best selling beer in the U. S. and the #1 beer sold by volume in the world. Let’s take a look into the marketing mix that makes this product so successful. Product. Bud Light was only preceded by Bamblinger and Miller in the â€Å"Light† beer segment of the industry and is brewed at all 12 Anheuser-Busch U. S. based breweries. It’s brewed with all natural ingredients (water, barley malt, rice, premium hops, and yeast) and the clean, crisp, smooth taste is derived from the two and six row malt and cereal grains used during fermentation. Each 12 ounce serving contains 110 calories, 6. 6 grams of carbohydrates and is 4. 2% alcohol by volume. Consumers in the beer segment are very open to try different types of beverages so having a unique taste and â€Å"superior drinkability† separates Bud Light’s product from its competitors. Place. Trespassing In Cyberspace Essay Introduction This paper will focus on one of the most contentious issues in cyberlaw, such as trespassing in cyberspace. While the issue of trespass as a sort of offense against a person or against property is carefully regulated in the majority of jurisdiction, the question whether trespass as a phenomenon can actually exist in cyberspace is a subject of heated debate. Thus, in-depth analysis of this question will help to understand its significance in the broader context of cyberlaw. Definition Under common law, trespass happens when a person intermeddles or performs unauthorized of another person’s property (Quilter, 2002). Pending the consensus among scholars concerning a clear-cut definition of trespass in cyberspace, courts and researchers often have to apply reasoning by analogy to analyze such cyberlaw cases: ‘The concept of trespass in cyberspace depends heavily on a conception of a web site or mail server as ‘property’ from which, like land, the owner ought to have the right to exclude others’ (Merges, Menell Lemley, 2006, p.928). One of the concepts that is most widely applied to cyberspace trespass cases is the concept of trespass to chattels, chattels being is defined as tangible property (not to be confused with real property and intellectual property). Trespass to chattels is a tort action under certain circumstances: ‘The tort of trespass to chattels traditionally requires proof not just that the defendant ‘intermeddled’ with a chattel, but that the defendants use actually caused injury to the chattel or injured the owner by depriving it of the benefit of using the chattel’ (Merges, Menell Lemley, 2006, p.923) However, the latter thesis is a contentious one, and further discussion of this issue will happen in the ‘Notable Cases’ section. The scholars argued that there are many concepts than need careful legal reconsiderations in the Information Age before any analogies with real property or chattels can be brought into the discussions. These concepts include, but not limited to, the notion of Intent, Entry, Property, and Permission (Adida et. al., 1998). Yet the idea of applying the doctrine of trespass to chattels to cyberspace turned out to be surprisingly appealing to judges: ‘Notwithstanding scholars’ early suggestions of its inappropriateness, courts have rushed to resurrect the late, largely unlamented, tort of trespass to chattels, and apply it to the new cyberspace arena’ (Cranor Wildman, 2003, p.13). At present, most scholars agree that the doctrine can be applied to such issues as spam and spidering when actual orb potential harm has been caused to a plaintiff. Legal Basis The foundational document that governs electronic transactions is Computer Fraud and Abuse Act of 1984 (CFAA). Computer Fraud and Abuse Act such issues with data integrity as in the situation when an offender breaks authorization rules instituted by an organization with a view to gaining access to protected information, such as information contained in a financial record of a financial institution, or of a card issuer. It also established penalties for acts or attempts to encroach on secret governmental information. However, the applicability of this Act can be made possible by proving that data and information resources can be regarded as chattels. Nowadays, it is an accepted fact in the legal practice, which was established by a series of legal precedents. Notable Cases In Thrifty-Tel v. Bezenek, it was established that electronic signals can be regarded as property due to the fact they are physical and tangible in nature. The analogy used in the case was the comparison of electronic signals to real property not chattels. Trespass to chattels first appeared in the case CompuServe v. CyberPromotions, which was a span case (Quilter, 2002). In United States v. Seidlitz, confidential software was illegally obtained by an employee by tapping into the work session of a previous worker. In this case, federal law was applied only because of an accompanying circumstance. Several  telephone calls the employee made to accomplish his aim were made across state lines.  Otherwise this employee would have had to be prosecuted under one state’s wire fraud legislation (Adida et. al., 1998). In United States v. Langevin, ex-worker of the Federal Reserve Board committed a similar offence. Being a financial analyst at the time when the offence was perpetrated, he tried to access the file containing protected data on money supply. Again, the applicability of federal legislation was made possible solely because of telephone calls made in the manner similar to the previous case (Adida et. al., 1998).    Another notable case, Intel v. Hamidi, was won by the defendant as the California Supreme Court ruled that Ken Hamidi did not commit an act of trespassing Intel’s computers by sending messages to its employees. After being fired from Intel in 1995, Ken Hamidi sent six emails to thousands of Intel’s employees with bitter criticism of the company’s policies and employee treatment. These messages did not result in physical damage on the company’s computer systems or failure of its networks or computer services. However, Intel decided to press charges against Mr.Hamidi accusing him of trespass. Intel claimed that workers were distracted and distressed as a result of disappointing emails, which further led to loss of productivity: ‘Intels position represents a further extension of the trespass to chattels tort, fictionally recharacterizing the allegedly injurious effect of a communications contents on recipients as an impairment to the device which transmitted the message’ (Epstein, 2004, p.15). Yet the court sided with the defendant on the grounds that no actual harm has been caused to Intel’s computer system: ‘The California courts have rejected trespass to chattels claims in the absence of evidence of actual harm to the chattel in question the computer server†¦ because the trespass to chattels tort†¦may not, in California, be proved without evidence of an injury to the plaintiffs personal property or legal interest therein.’ (Merges, Menell Lemley, 2006, pp.925-926). The significance of this case lies not only in the perceived victory for those who endorse cyberspace rights and fair labor relations. The case established a standard for legal reasoning in the cases of the like nature: ‘The decision noted that calling distressing content of a message a ‘trespass’ on the computer was as wrong as claiming that ‘the personal distress caused by reading an unpleasant letter would be an injury to the recipients mailbox, or the loss of privacy caused by an intrusive telephone call would be an injury to the recipients telephone equipment’’ (Electronic Frontier Foundation, 2003, para.3). The case eBay, Inc. v. Bidders Edge, Inc. is important for the discussion because it expanded the concept of trespass to chattels to spidering. Spidering is widely used by search engines to track information on Web serves. Bidder’s Edge was an auction aggregator that collected information from different auction sites, put it together in its own data bank, and then offered the information on demand as a to consumers looking for a certain item. eBay pressed charges against this company on the basis of trespass to chattels because of the company’s spider activity. The evidence of real harm resulting from Bidder’s Edge’s spidering was not allowed in the court, but the presence of potential harm was sufficient to rule that Bidder’s Edge was trespassing eBay’s information resources (Quilter, 2002). Other cases decided on the same grounds as are TicketMaster v. Tickets.com92 and Register.com v. Verio (Quilter, 2002). Impact While there is little discussion as to the benefits of application of trespass theory to spam emails, the issue is not that clear when it comes to spidering. It is widely believed that all the recent cases concerning trespass in cyberspace had far-reaching implications. Some scholars believe that the application of trespass to chattels doctrine to spidering may be detrimental to the development of e-commerce services: ‘While the promise of ecommerce is to improve consumer information and lower transaction costs, under a trespass theory many of those benefits will disappear’ (Merges, Menell Lemley, 2006, p.924). From the customer’s perspective, eBay’s victory was hardly beneficial for those seeking quality service: ‘AuctionWatch [a website run by Bidder’s Edge] was a better product for consumers than eBay, since it covered more auctions. However, eBay succeeded in shutting it down using the trespass to chattels tort. Any type of innovative aggregation product is subject to the same problem’ (Cranor Wildman, 2003, p.21). However, arguing against the doctrine of trespass in cyberspace from the position of customer’s satisfaction is not the most effective stance. In any legal case, there is a variety of stakeholders involved. The purpose of legal settling is to satisfy the demands of a plaintiff (if they have reasonable grounds) on the basis of existing laws and regulations. Companies operating in cyberspace merit protection just like customers do. Conclusion Despite the ongoing debate on the applicability of the concept of trespass to cyberspace offences, legal practice has already legitimized the relevance of certain common law doctrines (i.e. trespass to chattels) to such cases. Following the analogy with trespass to property such as land or personal possessions, courts have decided a series of exemplary cases based on the reasoning that electronic signals are physical and tangible enough to be regarded as property. Negative Impact Of Texting On Teenagers English Language Essay Texting is a very fast form of communicating with others. It consists of brief messages often typed in abbreviations known as text speak. Though it delivers thoughts with lightning speed, those who believe it is as, if not more effective than face to face conversations have their heads in the sand. Whether you are meeting someone for the first time or conversing with an old friend, face to face interactions have superior quality. Facial expressions can be seen, voice inflections heard and body language interpreted. Valuable verbal and nonverbal information essential to human interactions is lost in text messaging. In person conversations are self regulating while the silent nature of text messaging is not. Many young people text constantly no matter where they are or who they are with; hence, they are in a perpetual state of distraction and are unable to maintain focus beyond the next text. There is more to communication than sending and receiving bits of abbreviated text. Conveying emotions and feelings along with conversation adds depth and aids in interpreting meaning beyond words on a screen. Further, face to face communication allows for body language and facial expressions to enliven and enrich conversations and one another. Texting relies on emoticons (little faces that show happy, sad etc) which are a sorry replacement for human gestures and emotion. The purpose of interpersonal communication is to encourage the listener to fully grasp the thoughts and ideas the communicator wishes to convey. Though texting enhances access to others, it limits the ability to personally connect with others and bond. The more people choose texting to connect with others over interpersonal communication the further apart they become. In face to face communication people do not rely solely on words to understand what is being said. Intrapersonal communication is 7% spoken words, 38% tone of voice and 55% non verbal. This means that 93% of communication is determined by nonverbal cues; therefore, if text messaging is the chosen means of communication 93% of the intended message is lost. There are six types of nonverbal communication: facial expressions, eye contact, gestures, posture and body orientation, proximity and paralinguistics . Facial expressions confirm how information is being received and delivered. Smiling for example is an expression that is welcoming while scowling is the opposite. Eye contact is extremely important in that consistent (not starring or ogling) eye contact during a conversation makes the listener feel relevant, and heard. Gesturing can insert warmth, connectedness, and personality into one on one or group communications. Posture and body orientation (how you stand, walk and sit), sends a multitude of messages. A person who is shy or nervous may convey it by slouching or turning slightly away; contrarily, a confident, relaxed individual will exhibit a relaxed posture and face their conversation partner or group. Proximity is the distance an individual places between themselves and the person they are conversing with. If too much distance is placed between individuals it signals that one or both is uncomfortable with the conversation. It can also become uncomfortable if someone (particularly if they are not a friend) stands too close or touches too often. How your voice sounds is paralinguistics. Tone, inflection, pitch, volume and rhythm give richness and depth to a conversation. Computers and text messaging sources were originally created for data, not for the intricacies of human interactions. Yet, over seventy five billion text messages are exchanged each month in the United States. The majority of the texters are between the ages of thirteen and seventeen and each average two thousand, two hundred seventy-two texts a month. An extreme example was reported by Greg Hardesty, a reporter who wrote a story about his thirteen year old daughter racking up 14,528 texts in one month. After the story appeared in the Orange County Register, his daughters volume rose to 24,000 messages. Her parents took no action until after her grades fell precipitously. Teens lives being taken over by texting, By Donna George, The Washington Post, February 23, 2009). Some educators believe those consequences are currently surfacing in the classroom. They are seeing declines in word choices, spelling, the complexities of writing and an inability to stay focused. Further, educators are seeing text speak (LOL-laugh out loud, THX- thanks, L8R-later) and emoticons show up in assigned papers as well as a growing absence of punctuation (http://www.wsbt.com/news/national/40499712.html, Constantly Texting Teens Worry Parents, Experts, March1, 2009, Rockville Md. (AP). Many educators (and parents) are concerned about teens seeming inability to stay focused and tuned in to the world around them. Their attention is constantly divided between where they are at and what they are supposed to be doing and the next text message. It takes self-discipline to pay attention and learn and self discipline is not a character avid texters display. Texting distracts from the here and now of daily activities and interactions with others. A person is often exchanging texts with four or more individuals while trying to converse with others around them. Neither the in person or texting group has the full attention of the texter. The focus of the texters attention is constantly being pulled in several directions so no one benefits from the exchange. The same holds true in the classroom. To master the knowledge being presented, the full attention of the learner is required; therefore, a student who spends class time sending and receiving texts cannot be receiving the information required for learning. In the long run, it is the texter who loses from this addictive and rude behavior. Relationships both inside and outside the family deteriorate as does the quality and quantity of their education. Texting is undermining communication skills and therefore, human interactions. Texting is producing a generation that is self absorbed, distracted, unable to communicate in the here and now effectively and have no sense of propriety. Communication that is void of nonverbal cues and tones, laced with abbreviated speech which lacks grammar and punctuation and consumes ones time from dawn to dusk, clearly is destined to severely negatively impact the future of intrapersonal communication and interactions. Texting is inferior to communicating face to face and enjoying the richness and depth that language (verbal and nonverbal) provides.

Prejudice in The Merchant of Venice It is my strong belief that the play, "The Merchant of Venice", should be taught in classes. If this play was banned from schools it would most certainly be a form of censorship. The play teaches us about prejudice, and why it is wrong. People would see how everyone was hurt at one time or another by a prejudice, whether it was the Christians making fun of Shylock or Shylock showing his prejudice to the Christian's. I imagine that anyone watching, listening or reading this play would see how everyone was hurt, and would learn of racism's faulty basis's for judging someone. Some people would have you think that the play itself is racist, and provides a forum in which racism can grow and become only a bigger problem. I think that this is a flawed way of looking at it. I see the play as a confrontation of a modern day problem which society still faces. Rather than providing a forum for racism to grow, the play provides a forum for anti-racism discussion, if all proper steps are taken. When I say if all proper steps are taken, I am referring to having this play taught by a teacher, who can explain the plays meaning in it's fullest so that the students do not miss any important points from it. Another point that may have been missed when the presentation was made to the school board to ban the material from being taught inside the school system was that everyone is bad in the play. The Christians portrayal was just as bad as the Jewish man, Shylock's portrayal. In fact I think that the play gave a worse portrayal of the Christian's because they ended up being the most evil, through taking away everything that Shylock had and making him become Christian. While Shylock did want to kill someone, the punishment invoked on him was even worse. As you can see, there are many reasons why "The Merchant of Venice" should be taught in classrooms. A. Whitney Griswold said in a speech (1952), "Books won't stay banned. They won't burn. Ideas won't go to jail.

Overall, medical practice is carried out when physicians identify health concerns, e.g., diseases, mental disorders, and physical injuries, and provide treatments for patients in order to properly cure them of their maladies. Medical practice should be based on science—specifically, scientific research focused on discovering medical treatments—, ethical considerations regarding the wellbeing of patients that limit science, and intuition. However, because science is limited by ethical considerations and scientific evidence is sometimes unavailable, then the most important basis should be physicians’ intuition influenced by their past medical experience. On the whole, science plays a major role in the realm of medicine, as it is the foundation for the creation of new treatments and advancement of the medical field’s healing capability. Science is defined as field of knowledge based on discovering the truth about nature through formulating hypotheses and conducting research in an objective manner (Ehrenreich 19-20). The aspect of scientific research is significant because as more diseases and other medical conditions are identified, scientists need to determine possible cures and develop medicine in order for physicians to treat their patients. For example, neuroscientist V.S. Ramachandran recounts how patients with â€Å"reflex sympathetic dystrophy† participated in a scientific experiment that tested if there was a way to cure the unremitting pain associated with the syndrome (17). As a result of scientific research, a new and effective treatment for those with RSD was discovered when patients’ pain disappeared and mobility returned to limbs after undergoing a procedure that employed mirrors (18). Through the powers of science, variou... ...ck competence, sincerity, or diligence, but because they must make decisions about tremendously complex problems with very little solid evidence available to back them up† (Kumar and Nash 82-83). Though intuitive errors may be made, some of these are due to how the discovery of new ailments is continuous, and how humankind still does not understand everything about how illnesses and biological systems function. The treatment of medical conditions has still not been perfected and is the reason why the field of medicine is still attempting to discover new, innovative ways to cure diseases and other medical conditions. Though there may be certain issues regarding the individual doctors and their anomalous choices, overall the appropriate foundation for medical practice is a combination of the three facets of science, ethical considerations, and informed intuition.

The Hobbit The Hobbit by J.R.R. Tolkien is set in a fantasy world that has differences, as well as similarities, to our own world. The author has created the novel's world, Middle Earth, not only by using imagination, but by also adding details from the modern world. Realistic elements in the book enable readers to relate to the setting, yet have the ability to "imagine" exciting events and organisms not found on Earth. The majority of differences between Middle Earth and today's world are found in objects and the actions of characters that can not be carried out or created in our world. The most abundant example of this in The Hobbit is the presence of magic. Gandalf, the wizard, is able to help the adventurers out of a number of dangerous situations by using his magical powers to harm their enemies. He set Wargs afire while he was trapped in a tree and created a bolt of lightening to kill many of the Goblins who had surrounded the group in a cave. The magical ring, which was a key to helping the groups succeed in the book, allowed he who was wearing it to become invisible to others. Also, there was a black stream in Mirkwood that made he who drank out of it suddenly very drowsy and forgetful of previous events. All of these examples of happenings and objects found in Middle Earth are physically impossible in a world such as ours. Several of the organisms in the book are not known to exist on Earth. Hobbits, of course, are fictional characters, as are dwarves, elves, goblins, and trolls. Many species of animals are able to vocally communicate with humans and dwarves in the novel, which is not possible on our planet. Beorn, a human who is able to morph into other creatures at an instant, is an excellent example of such fiction. The dragon, Smaug, is the main adversary of the fourteen adventurers and is a type of creature that has long been used in fantasy writing. Although most of the characters' species are merely creations of the author, they all exhibit a sense of realism that causes them to seem almost human. There is a vast difference between Middle Earth and the modern world, but there are also several similarities. In Middle Earth, there live humans, and hobbits, which are very much similar to miniature people.

In 1892, a shoe maker named Homer Plessy from New Orleans Louisiana was arrested for refusing to transfer to a railroad car designated for the dark-colored population in the East Louisiana Railroad after he sat in a first class railroad car meant for the white-skinned constituents of the state. Plessy appealed that he should be considered white since only 1/8 of him was African American as it was substantiated in his heritage. According to him, by forcing him to transfer to a different car, the authorities were violating the 13th and 14th Amendments of the United States Constitution which impedes slavery and segregation. From local custody to Supreme Court, Plessy was tried and accused of civil disobedience (Elliot, 2009). The arbiters of the court exhibited linear cognition which disregarded Plessy’s plea of violation of rights and obstinately favored Luoisiana’s claim that they did not violate such Amendment of the United States Constitution since they have the right to imply regulations and policies in railroad stations that are within their state. Although it was considered that they should be relieved from their abject duties as slaves, a systematic arrangement for their freedom was never formed. Nat Turner’s act of rebellion caused that an anti-literacy law be passed which diminished the African American slaves’ freedom to communicate and have the opportunity to be educated, thus, almost completely mutilating their already restricted rights. From that historical event which became known as Nat Turner’s Rebellion or South Campton Insurrection, it can be analyzed that it might not only be a visionary or a delusioned man’s whim that caused such barbaric deeds but possibly an act or cry for liberation. Unequal treatment, enslavement for the rest of a man’s life and forced labor for very minimal or no wage at all, these are acceptable factors that can be considered as parts of a motive for the rebellion in South Campton. III In 1803, a British convict settlement was established in a Tasmanian aborigini inhabited island called Van Diemen’s Land. A total of of 65,000 convicted men and women were settled in the island of which most of them were cruelly traumatized and extremely violent. Due to the incompetent procedure of punishment, convicts were able to take flight into the Tasmanian hinterland where they exerted the fullness of their brutality and thirst of blood upon the aboriginis of the island (Turnbull, 1948) Symbolically and appropriately, this event in history can be described as a case of rape as the innocent aborigines were violated of their rights and freedom to live accordingly. Not only were they conquered and treated as slaves in their own land but they were exterminated and murdered like animals.
